US Atty: Not alleging Obama knew of Ill. gov. plan

CHICAGO – Federal prosecutors say the investigation into allegations that Illinois Gov. Rod Blagojevich (bluh-GOY’-uh-vich) tried to sell the Senate seat vacated by President-elect Barack Obama found no evidence that Obama did anything wrong.

At a news conference in Chicago on Tuesday, U.S. Attorney Patrick Fitzgerald reiterated a number of times that there were no allegations of impropriety on Obama’s part.

The governor is accused of conspiring to sell or trade Illinois’ vacant senate seat.

The 76-page FBI affidavit contends that governor was intercepted on wiretaps last month conspiring to shake people down, and it alleges he even considered appointing himself if he wasn’t offered anything of value.

CHICAGO (AP) — The U.S. Attorney in Chicago says his office is making “no allegations” that President-elect Barack Obama was aware of any alleged scheming by arrested Illinois Gov. Rod Blagojevich (bluh-GOY’-uh-vich).

Blagojevich was arrested on Tuesday on charges that he brazenly conspired to sell or trade the Senate seat left vacant by Obama to the highest bidder.

At a news conference on Tuesday, U.S. Attorney Patrick Fitzgerald said the corruption charges against the governor represent “a truly new low.”

An FBI affidavit says the 51-year-old Democrat was intercepted on wiretaps conspiring to sell or trade the vacant Senate seat for personal benefits for himself and his wife.

Fitzgerald described the situation by saying: “We were in the middle of a corruption crime spree and we wanted to stop it.”

The governor has repeatedly denied any wrongdoing.

Barack Obama campaigned on a pledge to change Washington, vowing to upend the K Street lobbying culture he encountered when he joined the U.S. Senate.

But more than a dozen members of President-elect Obama’s fast-growing transition team have worked as federally registered lobbyists within the past four years. They include former lobbyists for the nation’s trial lawyers association, mortgage giant Fannie Mae, drug companies such as Amgen, high-tech firms such as Microsoft, labor unions and the liberal advocacy group Center for American Progress.

Mark Gitenstein, one of the 12 transition board members who will play a significant role in shaping the Obama administration, worked on million-dollar lobbying contracts with the U.S. Chamber of Commerce and promoted legislation for giant defense contractors Boeing and General Dynamics. Until this fall, he was registered to petition Congress and the Securities and Exchange Commission on behalf of AT&T, Merrill Lynch, KPMG, Ernst & Young and others.

Gitenstein has blue-chip credentials for the volunteer role on the Obama team. He was chief Democratic counsel for the Senate Judiciary Committee during confirmation hearings for controversial Supreme Court nominee Robert H. Bork; was a close adviser to Vice President-elect Joseph R. Biden Jr.’s White House bid; and served as counsel to the Senate Intelligence Committee.

But his presence is also a reminder that Obama’s campaign pledge to keep his distance from the Washington lobbying culture may be tougher to fulfill than he anticipated.

“Nothing is going to change,” said Lanny Davis, a former special counsel to President Bill Clinton who did lobbying work for a range of companies after leaving the White House.

“From George Washington to George W. Bush, there has been a role for the lobbyist that is perfectly appropriate and good for democracy. The notion that there is something wrong per se with lobbying is ridiculous. But I favor more transparency and disclosure — online, in real time, for all lobbyists.”

The number of former lobbyists involved in Obama’s transition thus far is small compared with the past two transition teams, but they occupy several key positions. They include Biden’s incoming chief of staff, Ron Klain, who was signed up to lobby for Fannie Mae until 2005, and transition co-chair John Podesta, who lobbied for the Center for American Progress until 2006.

After serving as a top aide to Clinton and Vice President Al Gore, Klain represented a company facing asbestos-exposure lawsuits, the embattled drugmaker ImClone and two companies trying to win support for large mergers. His completed his last lobbying assignment, helping Fannie Mae with “regulatory issues,” in late 2004.

Obama’s formal policy during the campaign indicated that there may be some role for lobbyists in his administration, though his rhetoric did not always convey that. In a 2007 speech, he said he was “running to tell the lobbyists in Washington that their days of setting the agenda are over. They have not funded my campaign. They won’t work in my White House.”

A few days later, he changed the phrasing to say that lobbyists “are not going to dominate my White House.”

Among the first acts of Obama’s transition effort was the release of a formal policy on lobbyists, which Podesta described as “the strictest and most far-reaching . . . of any transition in history.”

The rules ban lobbyists from donating to the transition effort and lobbying during the transition period. Once Obama is sworn in, his advisers must wait a year before attempting to lobby the administration on any transition issues they handled.

The code also says that “if someone has lobbied in the last 12 months, they are prohibited from working in the fields of policy on which they lobbied.”

That one could be tricky for at least two transition team members. Gitenstein lobbied Congress on a broad spectrum of subjects such as “legal reform” during the past year, according to disclosure reports. As a senior advisory board member, his work could touch on a range of topics that would pose problems for him.

Another senior staff member, Patrick Gaspard, recently de-registered as a lobbyist on health-care issues for the Service Employees International Union. He is the transition team’s associate personnel director.

Transition officials declined requests to make Gaspard and Gitenstein available for interviews but said both are adhering to the ethics code.

“Patrick and Mark have jobs on the campaign that are general in nature, but per the unprecedented ethics policy laid out earlier this week they will recuse themselves from the fields of policy or agencies they lobbied in the previous 12 months,” said Dan Pfeiffer, the communications director.

Efforts to control influence-peddling go back decades. In the wake of Watergate, Congress passed criminal penalties for senior presidential appointees who, after leaving their posts, lobbied their former colleagues within a year. The law was strengthened in 1988 to cover a wider range of government officials.

During the 1992 presidential campaign, Clinton pledged to toughen the one-year lobbying ban. Hours after his swearing-in, he enacted a five-year ban in an executive order that covered about 1,000 appointees. But in 2000, just before leaving office, he lifted the five-year ban, citing bleak job prospects for many aides in the face of a Republican takeover. Podesta, then the White House chief of staff, drafted Clinton’s revocation.

Past president-elects have had differing approaches to the transition period, which presents a unique opportunity for lobbyists to shape government in ways that could help their clients and enhance their own business. President Bush’s policy demanded that transition workers avoid conflicts of interest, according to Michael Toner, who was chief counsel to the 2000 transition team.

Toner said excluding lobbyists altogether never struck him as advisable.

“Campaign rhetoric is one thing,” he said. “You’ve got to have serious people who know the inner workings of government.”

There is no true inauguration draft or true grant park construction going on. There will be a party, but we are boasting beyond the truth to make it seem like the election is wrapped up.

Obama: Failing to put up basic blocks against fraudulent giving.

Barack Obama has proved the greatest fund-raiser of all time by a long shot. His campaign has raised more than $600 million - $150 million in September alone. But the campaign has also failed to adopt standard protections against fraudulent giving.

The average contribution to Obama in September was just under $86. And federal law only requires the disclosure of identifying information for contributions in excess of $200. Campaigns must keep running totals for each donor and report them once they exceed $200.

The Federal Election Commission says the Obama campaign has reported well over $200 million as coming from contributions of $200 or less. Only a small portion of that sum is attributable to donors the Obama campaign has disclosed.

No presidential campaign has ever before received such a gargantuan sum of money from unidentified contributors.

The campaign’s records reveal big contributors with names like “Doodad Pro” (employer: “Loving,” profession: “You”) and “Good Will” (same employer and profession). Both donated via credit card. Other reports have suggested that some donations come from overseas - raising the question of whether Obama is accepting donations from foreigners, another violation of federal law.

All of which prompted an enterprising citizen to test the controls put in place to enforce compliance with federal campaign law by the Obama and McCain campaigns. Last Thursday, he decided to conduct an experiment.

He went to the Obama campaign Web site and made a donation under the name “John Galt” (the hero of Ayn Rand’s novel “Atlas Shrugged”). He provided the equally fictitious address “1957 Ayn Rand Lane, Galts Gulch, CO 99999.”

He checked the box next to $15 and entered his actual credit-card number and expiration date. He was then taken to the next page and notified that his donation had been processed.

He then tried the same experiment on the McCain site, which rejected the transaction. He returned to the Obama site and made three more donations using the names Osama bin Laden, Saddam Hussein and Bill Ayers, all with different addresses but the same credit card. The transactions all went through. By Saturday, he’d reported that the transactions had all posted to his credit-card account.

Others repeated “John Galt’s” experiment last week, giving to Obama under such fictitious names as Della Ware, Joe Plumber, Idiot Savant, Ima BadDonation (with a Canadian bank card) and Fake Donor.

What accounts for the Obama campaign’s acceptance of these fraudulent donations? Most merchants selling goods and services use the basic Address Verification System that screens credit-card charges for matching names and addresses. (It can also screen cards issued by foreign banks.) The McCain campaign uses AVS and provides a searchable database of all donors, including those who fall below the $200 threshold. The Obama campaign apparently has chosen not to use the AVS system to screen donations.

“Della Ware” contacted The New York Times to report her experience contributing under a fictitious name and address (”12345 No Way”) to the Obama campaign, while her contribution was rejected by the McCain campaign. Times reporter Michael Luo verified “Della Ware’s” account and reported it online at the Times’ campaign blog. But Luo missed the story’s point.

“To be fair to the Obama campaign,” he wrote, its “officials have said much of their checking for fraud occurs after the transactions have already occurred. When they find something wrong, they then refund the amount.”

But the Obama campaign is running a system that complicates the discovery of “something wrong.” It has chosen to operate an online contribution system that facilitates illegal falsely sourced contributions, illegal foreign contributions and the evasion of contribution limits.

Obama backers making such contributions may not be worried that “something wrong” will be detected if they have no intention of complaining about it.

According to journalist Kenneth Timmerman, the Obama site did not ask for proof of citizenship until just recently - in contrast not just with McCain but also with Hillary Clinton. Sen. Clinton’s presidential campaign required US citizens living abroad to fax copies of their passports before it would accept donations. By contrast, foreign donors to Obama can just use credit cards and false addresses.

Why has the Obama campaign chosen to operate without the basic automated credit-card controls that would prevent or hamper fraud and illegal contributions? Has it made a conscious decision to assist the evasion of federal campaign law or worry about it after it has had the use of the money?

It’s hard to see any other motive.

members to public office with the aim of moving the Democratic Party far leftward to ultimately form a new political party with a socialist agenda.Several blogs, including Powerline, previously documented that while running for the Illinois state Senate in 1996 as a Democrat, Obama actively sought and received the endorsement of the socialist-oriented New Party, with some blogs claiming Obama was a member of the controversial party.

The New Party, formed by members of the Democratic Socialists for America and leaders of an offshoot of the Community Party USA, was an electoral alliance that worked alongside the Association of Community Organizations for Reform Now, or ACORN.
